Re:
Capitol Records LLC v. ReDigi Inc., et al. (12 Civ. 00095) (RJS)
Hon. Judge Sullivan,
Pursuant to the Court’s July 25 Order, Mishcon de Reya New York, LLP (“Mishcon”)
submits this statement of the amount owed by Defendants ReDigi Inc., John Ossenmacher, and
Larry Rudolph a/k/a Lawrence S. Rogel (“Defendants”).
As noted in Mishcon’s Motion to Withdraw and the Raskin Declaration in support thereof,
Mishcon has been paid neither its fees nor reimbursement for expenses incurred. In connection
with its retaining lien, Mishcon is only seeking payment for the out of pocket expenses it incurred
on behalf of Defendants.
Mishcon, in preparation for trial on the damages issues, retained the services of a third
party vendor to make copies and assemble trial exhibits and other necessary documents. The
invoice for this work totaled $5,266.12. Ex. 1. After Defendants informed Mishcon that they
would not pay this invoice, Mishcon paid it in order to maintain its relationship and reputation
with the vendor.
Mishcon is not asserting any fees owed in connection with its retaining lien.
