ASSIGNMENT OF COPYRIGHT
WHEREAS Martin S. High (“MSH”) was, at all times relevant hereto, “of
counsel” to the law firm of Edward L. White, P.C. (“ELW”); and
WHEREAS, MSH participated in the creation of: (i) Plaintiffs’ Combined Motion
for Summary Judgment for Plaintiffs Beer and Ramsey and Brief in Support, dated May
20, 2009, with Copyright Registration Number TX0007259439 / 2010-05-20 and;
(ii) Plaintiff’s Motion in Limine, dated March 15, 2010, with Copyright Registration
Number TX0007417300 / 2010-05-21 (the “Works”); and
WHEREAS, MSH and ELW have at all relevant times mutually agreed and
understood that ELW is the sole owner of all rights in the Works, including but not
limited to all rights of an Author under the Copyright Act, 17 U.S.C. § 101 et seq.; and
WHEREAS, MSH and ELW mutually desire to remove any question concerning
the authorship and ownership of the Works;
NOW, THEREFORE, for good and valuable consideration the sufficiency of
which is hereby acknowledged, MARTIN J. HIGH hereby permanently and irrevocably
assigns to EDWARD L. WHITE, P.C. all right, title, and interest in the Works that he
may have (if any), including but not limited to all rights under the Copyright Act, to the
fullest extent permissible by law, together with all rights to secure renewals, reissues, and
extensions of the copyrights of the Works. It is the intention of the parties that, to the
fullest extent permissible by law, this Assignment be effective as of the date of the
creation of each of the Works.
