[PROPOSED] ORDER OF THE COURT GRANTING EXPEDITED HEARING AND
SETTING RESPONSE DEADLINES ON DEFENDANTS’ FOURTH MOTION TO
COMPEL
Upon the Motion for an Expedited Hearing on Defendants’ Fourth Motion to Compel and
it appearing that Defendants have shown sufficient cause to conduct a hearing on an expedited
basis, the Court hereby ORDERS, ADJUDGES and DECREES as follows:
1.

The request for an expedited hearing is GRANTED as set forth herein.

2.

The Court shall conduct a hearing on Defendants’ Fourth Motion to Compel at the
already scheduled hearing on December 13, 2012 at 12:00pm at 2 Niagara Square,
U.S. Courthouse, Buffalo, New York 14202.

3.

Any opposition to Defendants’ Fourth Motion to Compel shall be filed with the
Court and served upon counsel for Defendants on or before December 8, 2011.

4.

Any reply in support of Defendants’ Fourth Motion to Compel shall be filed with
the Court and served upon counsel for Plaintiff on or before December 12, 2011.

5.

Those individuals receiving notification of court filings via the ECF electronic
notification system shall be deemed to be served on the day of filing.
