AMANDA M. AYCOCK

I, AMANDA M. AYCOCK, hereby declare under penalty of perjury that the following is
true and correct:
1.

I am an attorney licensed to practice law in the State of New York and admitted to

practice before this Court. I am an associate attorney at the law firm of Gibson, Dunn &
Crutcher LLP, and counsel of record for Defendants Mark Elliot Zuckerberg and Facebook, Inc.
in the above-captioned matter. I make this declaration, based on personal knowledge, in support
of Defendants’ Opposition to Plaintiff’s Motion to Strike New Expert Reports and for Order
Prohibiting the Filing of New Expert Reports in Support of Defendants’ Motion to Dismiss for
Fraud on the Court.

Attached hereto as Exhibit A is a true and correct copy of an email exchange

dated August 6, 2012 among Alexander Southwell, Dean Boland, and Paul Argentieri with the
subject “Cancellation of Lesnevich Deposition” in which Southwell informs Boland and
Argentieri that he has “received your email and acknowledge that you are cancelling the
deposition of Mr. Lesnevich on Wednesday. . . . Mr. Lesnevich was planning to provide some
