UNITED STATES DISTRICT COURT FOR THE MIDDLE DISTRICT OF NORTH CAROLINA RYAN McFADYEN, ET AL., Plaintiffs, vs. Case No: 1:07-cv-953 DUKE UNIVERSITY, ET AL., Defendants. ORDER Upon consideration of the Joint Motion to Extend Page Limitations and to Establish a Rule 12 Briefing Schedule ("Joint Motion"), for good cause shown and by agreement of the parties, it is hereby ORDERED that: 1. 2. The Joint Motion is GRANTED; Each of the Defendants or Defendant-groups enumerated below shall have up to and including 75 pages to brief their respective motions to dismiss ("Motions"), and up to and including 25 pages to brief their respective reply memoranda ("Replies"): a. b. c. d. e. f. g. h. i. j. k. 3. Duke University Defendants; Duke SANE Defendants; The City of Durham, NC; The Durham Police Supervising Defendants; Durham Police Defendants; Edward Sarvis; Ronald Hodge; Mark Gottlieb; Benjamin W. Himan; DNA Security, Inc. and Richard Clark; and Brian Meehan. The Duke University Defendants and Duke SANE Defendants may aggregate the page limits applicable to their respective Motions as well as their Replies, resulting in a total combined limit of 150 pages for their two Motions and a total combined limit of 75 pages for their two Replies. 4. The Plaintiffs may have up to 75 pages to file Opposition Briefs ("Oppositions") in response to each Motion. Further, to the extent Plaintiffs wish to address common issues raised by multiple Defendants and/or Defendant-groups, the Plaintiffs may file a Consolidated Opposition Brief that responds to common issues raised in multiple Motions. The Plaintiffs' Consolidated Opposition Brief may exceed 75 pages so long as the total pages contained in all of Plaintiffs' opposition briefs together do not exceed the total pages allocated to the Defendants' motions. 2 5. The following briefing schedule shall apply to the Motions, Opposition(s) and Replies in this matter: a. b. c.
