Mr. Cary has recently accepted an appointment to serve as the General Counsel of the North Carolina Department of Environment and Natural Resources, which position will necessitate his withdrawal from the private practice of law. Defendants DNA Security, Inc. and Richard Clark are represented by other counsel who have previously made appearances before this Court in this case and Mr. Cary’s withdrawal will not prejudice said Defendants.
