The matter came before the undersigned on the Motion by Duke University
(“Duke”), for an order striking Plaintiffs’ reply brief [DE 309] regarding Plaintiffs’
Motion for Extension of Time to File a Reply Brief [DE 305] and declaring
briefing closed as of 18 October 2012 on the Motion for Protective Order for the
Deposition of Plaintiffs’ Litigation Counsel [DE 294]. Finding the Motion well
taken, and for good cause shown, the Court HEREBY GRANTS Duke’s Motion.
THEREFORE, it is ORDERED that that the reply brief [DE 309] filed on 19
October 2012 is stricken, and that briefing closed on the Motion for Protective
Order for the Deposition of Plaintiffs’ Litigation Counsel [DE 294] on 18 October
2012.

It having been ORDERED that briefing is now closed on the Motion for
Protective Order for the Deposition of Plaintiffs’ Litigation Counsel [DE 294], the
Clerk is directed to refer that Motion to the undersigned for a decision on the
merits.
