Before the Magistrate Judge were Defendants' m o tion for summary judgment (Docs. 21 and 33). Proper notice has been given to the parties under 28 U.S.C. § 636(b)(1)(C), including n o tice that the parties would waive further appeal if they failed to file objections to the Report a n d Recommendation in a timely manner. See United States v. W a lters , 638 F.2d 947 (6th C ir. 1981). No objections to the Magistrate Judge's Report and Recommendation have been file d and time to do so has expired. Having reviewed this matter de novo pursuant to 28 U.S.C. 636, this Court finds the Magistrate Judge's Report and Recommendation to be correct. A c c o rd in g ly, it is ORDERED that the Report and Recommendation of the Magistrate J u d g e is hereby ADOPTED. Defendants' motions for summary judgment (Docs. 21 and 33) a re hereby GRANTED. All other pending motions are hereby DENIED, as moot (Docs. 10, 1 2 , 19, 25, 38). This matter is now closed. The Clerk of Court is directed to terminate this m a tte r from the docket of this Court.
