SUPPLEMENTAL DECLARATION OF CHRISTOPHER FINAN Christopher Finan declares under penalties of perjury: 1. I am the President of the American Booksellers Foundation for Free Expression

("ABFFE"), a plaintiff in this action. I submit this supplemental declaration on behalf of ABFFE in support of plaintiffs' application for declaratory relief and a permanent injunction. 2. Many ABFFE members are bookstores and booksellers, approximately 36 of

which are located in the state of Oregon, including five of the named bookseller plaintiffs. The Oregon members are listed on Attachment A. 3. Attached hereto as Attachment B is a list of items which are offered for sale by

ABFFE members in the State of Oregon.
