JUDGMENT ORDER AND NOW, this 28th day of March, 2007, upon consideration of Defendant Google, Inc.'s Amended Motion to Dismiss, or in the alternative, to Transfer (Docket No. 8), which the Court converted to a Motion for Summary Judgment (Docket No. 12), on claims asserted in Plaintiff's Amended Complaint (Docket No. 6), Defendant's Supplemental Memorandum in Support of Motion to Dismiss Amended Complaint (Docket No. 16), and Plaintiff's Responses in Opposition thereto (Docket Nos. 9, 10, and 21), as well as, Plaintiff's Motion for Summary Judgment (Docket No. 19), Defendant's Response in Opposition thereto (Docket No. 23), and Plaintiff's Reply (Docket No. 24), it is hereby ORDERED that Defendant's Motion to Transfer is GRANTED and Plaintiff's Motion for Summary Judgment is DENIED for the reasons set forth in the attached memorandum. Accordingly, the above-captioned matter is TRANSFERRED to the Northern District of California, San Jose Division. BY THE COURT:
