PLAINTIFF'S MOTION FOR AN ORDER OF DESTRUCTION OF COUNTERFEIT GOODS

The plaintiff, Taylor Swift ("Plaintiff"), by and through undersigned counsel, and pursuant to 15 U.S.C. § 1118, hereby moves that the Court enter an order of destruction of any and all counterfeit materials seized from any unidentified defendants in this case and from the defendants Malcolm Matthews, Renee Susan Mitchell, Louis Moore, Marsha Dyonne Tyler, Mellissa Lieberman, Edward Friedman, Kenneth Johnson and Taief Hasson Wallace 1

("Defendants"), under the Court's Temporary Restraining Order and Order of Seizure of Counterfeit Goods, entered on May 19, 2009 (Docket 12), Order Granting Plaintiff's Motion to Extend Temporary Restraining Order and Order of Seizure of Counterfeit Goods, entered on May 28, 2009 (Document 17), and/or the Preliminary Injunction and Order of Seizure of Counterfeit Goods, entered on June 17, 2009 (Document 33), and presently held in the custody of the Court. Destruction of Defendants' counterfeit goods is authorized by Section 1118 of Title 15 of the U.S. Code, 15 U.S.C. § 1118, because this is an action arising under, among other causes of action, Chapter 22 of Title 15 of the U.S. Code, trademark infringement, trademark dilution and false designation of origin, in violation of the Trademark Act, 15 U.S.C. § 1051 et seq., and use of counterfeit marks, in violation of the Trademark Counterfeiting Act of 1984, 15 U.S.C. § 1116(d), in which a violation of Plaintiff's trademark rights has been established (See Order of Default Judgment, Permanent Injunction and Destruction of Counterfeit Goods; Document 109), and because Plaintiff has given the requisite notice of this Motion to the U.S. Attorney for the Middle District of Tennessee, in accordance with 15 U.S.C. § 1118 (Document 104).
