See attached Jim Warriner Eric Hansen Shelly Holmes, CSR Jan Lockhart ATTORNEYS FOR PLAINTIFF: ATTORNEYS FOR DEFENDANTS: LAW CLERK: COURT REPORTER: COURTROOM DEPUTY: 1:32 p.m. Court opened. The parties announced ready for hearing. The Court gave counsel for the parties' instructions regarding jury selection and trial. The Court will seat a ten-person jury with four strikes per side. After jury selection on Monday, August 2, 2010, the Court will conduct an evidentiary hearing to pre-admit trial exhibits. Opening statements will start after lunch. Counsel for the Plaintiff requested 13 hours per side to try the case. Counsel for the Defendants requested 20 hours per side. The Court will issue an Order concerning time for trial later in the week. The Court gave the parties instruction regarding expert witness testimony. Counsel read into the record agreements on the parties' Motions in Limine. The Court then heard argument and made rulings on the remaining issues with respect to Motions in Limine. The Court heard argument with respect to affidavit disputes between the parties. Counsel for the Defendants are to provide the Court with an outline, by Monday morning, regarding testimony concerning trade secret protection issues. Dockets.Justia.com Page Two Minutes July 28, 2010 The Court will set a date sometime after the trial for inequitable conduct and laches. The parties may submit notebooks for the jury with a copy of the patent and definitions. Anything beyond this provision must be agreed to by the parties. The parties are to meet and confer regarding witness lists by close of business on Thursday, July 29, 2010. Each side will be given 30 minutes for voir dire examination. The Plaintiff will have 30 minutes for opening statements and Google and Yahoo! will have 20 minutes each. 3:16 p.m. Court adjourned.
