Civil Action No. 2:07-CV-486-CE ORDER GRANTING DEFENDANT'S MOTION TO COMPEL 30(b)(6) DEPOSITION TESTIMONY FROM JARG CORPORATION AND NORTHEASTERN UNIVERSITY Before the Court is Defendant Google Inc.'s ("Defendant") Motion to Compel 30(b)(6) Deposition Testimony From Jarg Corporation and Northeastern University, filed on November 26, 2008. After considering the Motion, the Court finds that the Motion should be GRANTED. Accordingly, it is ORDERED that Plaintiffs Jarg Corporation and Northeastern University are hereby precluded from amending their P. L.R. 3-1 infringement contentions served September 9, 2008 to add or include any infringement theory not already expressly disclosed therein. It is further ORDERED that Plaintiffs Jarg Corporation and Northeastern University are hereby precluded from offering any testimony, including but not limited to trial testimony, in addition to that provided by Northeastern University witness Anthony Pirri and Jarg Corporation witness James Belanger on September 23 and 25, 2008, respectively, pertaining to the three topics for examination identified in Defendant's September 3, 2008 First Notices of Deposition to Plaintiffs Northeastern University and Jarg Corporation.
