REPLY TO MOTION TO SET HEARING ON OUTSTANDING ISSUES
Rockstar files this short Reply to address Google’s contention that somehow Rockstar’s
Motion was misleading and also to address the possible date of any hearing. Rockstar and
Google specifically discussed holding a hearing within the next 2-3 weeks, including Rockstar
suggesting particular dates. Google indicated that it did not wish to propose a particular agreed
date and that the parties could address any scheduling issues after the Court set a hearing date.
Rockstar then specifically stated that it would leave it up to the Court to set the particular hearing
date. See Exhibit 1. Regardless, from the email chain, it appears that Google indicated its
availability on November 21, 2014. Rockstar also is available that date. Rockstar is at the Court’s
pleasure on any appropriate hearing date, and both parties agree the hearing should include any
open issues.
