("Apple") (collectively, "the parties") hereby move to extend the deadline to comply with Patent Local Rule 4-3(a)-(c) and (e) until Monday, November 16, 2009, the deadline to comply with Patent Local Rule 4-3(d) to Wednesday, November 25, and to extend the discovery deadline for claim construction issues under P.R. 4-4 to December 17, 2010. The parties' present deadline to comply with Patent Local Rule 4-3 is Friday, November 13, 2009, and the discovery deadline for claim construction issues under Patent Local Rule 4-4 is November 23, 2009. The parties are still engaging in the meet and confer process to narrow the claim construction disputes. In addition, the parties wish to ensure that there is adequate time to schedule and complete depositions of witnesses in connection with claim construction issues. Accordingly, the parties respectfully request the Court to extend the time to comply with Patent Local Rule 4-3(a)-(c) and (e) to Monday, November 16, 2009, the deadline to comply with Patent Local Rule 4-3(d) to Wednesday, November 25, and the discovery deadline for claim construction issues under Patent Local Rule 4-4 to December 17, 2009. This extension is not sought for the purpose of delay, but instead so that justice may be served. A proposed order granting the parties' motion for extension is attached hereto.
