Ken I am glad we were finally able to connect today. As we discussed, you've asked to have until the end of the day next Tuesday to decide whether you will oppose our request for leave to file the counterclaim despite having passed the deadline in the docket control order, and we have agreed to wait until then in the hopes that we can avoid having to file a contested motion on this issue.
