(DE #169), concludes that the motion is not well taken and therefore DENIES the motion. Accordingly, it is ORDERED, ADJUDGED and DECREED that Non-Party Witnesses Bart Showalter, Kevin Meek, Douglas Kubehl, Kurt Pankraz, and Jillian Powell are ORDERED to appear as subpoenaed. IT IS SO ORDERED.
