ORDER DENYING AOL'S EMERGENCY MOTION FOR LEAVE TO FILE AOL'S MOTION FOR SUMMARY JUDGMENT OF NONINFRINGEMENT OF U.S. PATENT NO. 5,893,120 FOR LACK OF PERFORMANCE [DKT. 505] Before the Court is AOL's Emergency Motion for Leave to File AOL's Motion For Summary Judgment of Non-Infringement of U.S. Patent No. 5,893,120 for Lack of Performance [Dkt. No. 505]. The Court is of the opinion that AOL's motion should be DENIED. It is therefore ORDERED that AOL's motion is hereby DENIED, and AOL's motion [Dkt. No. 507] is accordingly STRICKEN.
