ORDER DENYING AOL INC.'S MOTION FOR CLARIFICATION AND RECONSIDERATION OF JUDGE LOVE'S ORDER DENYING SUMMARY JUDGMENT REGARDING THE LEGAL ISSUE OF WHETHER MERE CAPABILITY IS SUFFICIENT FOR INFRINGEMENT OF CLAIMS 1-2 OF THE `120 PATENT On this day came to be considered AOL's Motion for Clarification and Reconsideration of Judge Love's Order Denying Summary Judgment Regarding the Legal Issue of Whether Mere Capability is Sufficient for Infringement of Claims 1-2 of the '120 Patent (Dkt. No. 665). After considering the Motion and all papers filed in support and opposition thereof, the Court finds that the Motion should be DENIED.
