I, Christopher M. Joe, declare under penalty of perjury as follows:
1.

I am an attorney at the law firm of Buether Joe & Carpenter, LLC and counsel

of record for Defendant J.C. Penney Corporation ("J.C. Penney") in the above-referenced action.
2.

I have knowledge of the facts in this matter, and items reflected in J.C. Penney' s

Bills of Costs and supported by the exhibits and invoices submitted with the Bill of Costs are
allowed by law, correctly stated, and have been necessarily incurred in the defense of this case.
3.

The costs reflected in J.C. Penney' s respective Bills of Costs were incurred by
