UNOPPOSED MOTION REQUESTING CERTAIN PLEADINGS BE SEALED
Defendants Amazon.com, Inc., Google, Inc., J.C. Penney Corp., Inc., Yahoo! Inc., and
YouTube LLC (collectively the “Defendants”) respectfully request that the Court seal certain
exhibits attached to Dkt. No. 1342 filed with the Court.
On February 8, 2012, Defendants filed a trial brief with the Court. (Dkt. No. 1342)
Defendants’ trial brief included several Exhibits which contain confidential material and were
properly marked confidential under the Court’s Protective Order. Specifically, Exhibit C (an unredacted version of the Supplemental Expert Report of Richard L. Phillips dated October 27,
2011), Exhibit H (the deposition of David Filo), and Exhibit I (the deposition of Christopher
McRae) were filed without seal by mistake.
The parties have met and conferred regarding this motion. Plaintiffs have agreed not to
oppose Defendants’ motion. No party has any objection to the disclosure of the publically
disclosed trial exhibits.

Accordingly, the Defendants request the Court enter an order that Exhibit C, Exhibit H,
and Exhibit I of the pleading filed as Dkt. No. 1342 be sealed.
