Plaintiff, Civil Action No. 6:09 -CV-446 LED V. JURY TRIAL DEMANDED ADOBE SYSTEMS, INC., ET AL. Defendants. [PROPOSED] ORDER The Court, having considered Defendant Adobe Systems Incorporated's ("Adobe") Opposed Motion Requesting Case Management Conference to Address Plaintiff Eolas's Infringement Contentions or, in the Alternative, to Strike Those Contentions and Motion for Expedited Consideration, finds the Motion should be granted. IT IS THEREFORE ORDERED that: The Court strikes Eolas's existing infringement contentions. The Court shall hold a case management conference on to establish deadlines for Eolas to: (1) supplement its infringement contentions to provide the specificity required by the Patent Local Rules, (2) specify for each claim whether or not it includes a Microsoft product, process, instrumentality or system to satisfy any element of that asserted claim; and (3) provide clear parameters for document production (including whether and when the Court might entertain potential procedures for cost shifting to keep document production as focused as possible). 1 Dockets.Justia.com
