The undersigned and Defendant J.C. Penney Corporation, Inc. move the Court for an order

permitting the withdrawal of Jeffrey K. Joyner and Jeffrey F. Yee of the firm of Greenberg
Traurig, LLP from further representation of J.C. Penney Corporation, Inc. in this action.

Eric W. Buether, Christopher M. Joe, and Brian A. Carpenter of Buether Joe & Carpenter

will remain as lead counsel for J.C. Penney Corporation,Inc. in this case.
Plaintiff Eolas Technologies, Inc. does not oppose the withdrawal, and the withdrawal of
Jeffrey K. Joyner and Jeffrey F. Yee will not have a materially adverse affect on J.C. Penney
Corporation,

Inc.

J.C. Penney Corporation, Inc. remains represented by competent counsel who

was designated as lead counsel in this action and is fully capable of representing J.C. Penney

Corporation,Inc.'s interests. Therefore, the undersigned and J.C. Penny Corporation, Inc. request
