AS COUNSEL OF RECORD FOR DEFENDANT FRITO-LAY, INC.
The undersigned and Defendant Frito-Lay, Inc. (“Frito-Lay”) move the Court for an order
permitting the withdrawal of Eric W. Buether, Christopher M. Joe and Brian A. Carpenter of the
firm of Buether Joe & Carpenter, LLC from further representation of Frito-Lay in this action.
Mr. Jeffrey K. Joyner and Mr. Jeffrey F. Yee of Greenberg Traurig, LLP will remain as
counsel of record, and Mr. Joyner will remain as lead counsel for Frito-Lay.
Plaintiff Eolas Technologies Incorporated does not oppose the withdrawal, and the
withdrawal of Eric W. Buether, Christopher M. Joe and Brian A. Carpenter will not have a

materially adverse affect on Frito-Lay as it remains represented by competent counsel who are
fully capable of representing the interests of Frito-Lay.
WHEREFORE, PREMISES CONSIDERED, the undersigned and Frito-Lay request this
Court to grant this Motion to Withdraw Buether Joe & Carpenter, LLC as counsel of record for
Frito-Lay.
