R. Civ. P. 12(b)(6) Based On The Failure Of The Patent-In-Suit To Claim Patentable Subject Matter Under 35 U.S.C. § 101 and finding the same to be meritorious, the Court hereby grants the same. IT IS THEREFORE ORDERED that the Complaint against Classmates should be dismissed with prejudice for failure to state a claim because the `722 patent does not claim patent-eligible subject matter.
