Defendants Alcatel-Lucent USA INC. (“Alcatel-Lucent”), and HTC Corporation, HTC America,
Inc., and Exedea Inc. (“HTC”) (collectively “Defendants”) file this Notice of its letter brief to the
Court requesting permission to file a motion for summary judgment of invalidity of claims 1-5 of
U.S. Patent No. 6,381,211 (“the '211 patent”) and claims 1-5 of U.S. Patent No. 6,088,326 (“the
'326 patent”). A copy of the letter brief attached hereto and filed herewith as Exhibit A.
