IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF TEXAS TYLER DIVISION WI-LAN INC., Plaintiff, v. ALCATEL-LUCENT USA INC. et al., Defendants. § § § § § § § § § § § Civil Action No. 6:10-cv-521-LED Civil Action No. 6:13-cv-252-LED CASES CONSOLIDATED FOR TRIAL JURY TRIAL DEMANDED WI-LAN INC., TELEFONAKTIEBOLAGET LM ERICSSON, ERICSSON INC., SONY MOBILE COMMUNICATIONS AB, AND SONY MOBILE COMMUNICATIONS (USA) INC.’S UNOPPOSED MOTION FOR EXTENSION OF TIME TO FILE REPLY IN SUPPORT OF THEIR JOINT MOTION TO SEAL CERTAIN TRIAL EXHIBITS Plaintiff Wi-LAN Inc., and Defendants Ericsson Inc., Telefonaktiebolaget LM Ericsson, Sony Mobile Communications (USA) Inc., and Sony Mobile Communications AB (collectively, “Movants”) respectfully move the Court to extend the time for Movants to reply to AlcatelLucent and HTC’s Opposition (Dkt. No. 495) to Movants’ Joint Motion to Seal Certain Trial Exhibits (Dkt. No. 485) through and including October 4, 2013. The HTC Defendants do not oppose this request. In support of this motion, Movants would show as follows: Following trial, Movants filed a motion to seal a limited number of sensitive trial exhibits. (Dkt. No. 485.) Only Alcatel-Lucent and the HTC defendants opposed Movants’ motion, and only in part with regard to a subset of exhibits. By stipulation dated September 17, 2013, and pursuant to the Court’s Order dated September 18, 2013, Alcatel-Lucent withdrew its opposition to Movants’ Motion. (Dkt. Nos. 499, 500.) Subsequently, on September 18, 2013, Wi-LAN announced that Wi-LAN and HTC have reached an agreement to resolve all pending litigations between them. Wi-LAN expects that HTC and Wi-LAN will file dismissal papers, including a withdrawal of HTC’s opposition to Movants’ Motion, in the near future. Accordingly, Movants respectfully request a brief extension of time to determine to what extent, if any, the Motion remains opposed.1 Movants seek this extension of time not for delay but for good cause and that justice may be served. WHEREFORE, for good cause shown, Movants respectfully request that the time to reply to Defendants’ Opposition (Dkt. No. 495) be extended through and including Friday, October 4, 2013.
