DEFENDANTS’ UNOPPOSED MOTION TO EXTEND DEADLINE TO SUBMIT TRIAL EXHIBITS
On October 7, 2013, the Court granted the Joint Motion to Seal Certain Trial Exhibits,
and ordered the parties to submit to Chambers a disk of the unsealed exhibits and a disk of the
sealed exhibits within fourteen days, or by October 21st. In assembling the disks containing
Defendants’ exhibits, counsel for the Ericsson and Sony Mobile Defendants determined that
three of the Defendants’ physical exhibits (DX-205, DX-280, and DX-283) were in the
possession of counsel for Alcatel-Lucent USA Inc., which was dismissed from this action in
September.
Counsel for Alcatel-Lucent has stated that it will be unable to provide the physical
exhibits to Ericsson and Sony Mobile’s counsel in time to meet the Court’s submission date of
October 21st but that the documents will be provided during that week.
Accordingly, Defendants respectfully request that the Court grant this motion and extend
the deadline until and including October 25, 2013, for the parties to submit the complete set of
exhibits.
