ORDER GRANTING DEFENDANT'S MOTION FOR A NEW TRIAL ON DAMAGES AND MOTION FOR REMITTITUR The Court, having considered the above-captioned motion by Defendant Nintendo of America Inc. ("Nintendo") and the arguments and submissions of the parties with respect thereto, hereby GRANTS Defendant's Motion. IT IS HEREBY ORDERED AND ADJUDGED that the damages awarded to Plaintiff Anascape, Ltd. ("Anascape") shall be remitted to $2,727,799.95. IT IS FURTHER ORDERED AND ADJUDGED that Anascape shall have seven (7) days from the entry of this order to either elect the remitted award of $2,727,799.95 or to have a new trial on the issue of damages.
