This cause coming before this Court on the Joint Motion for Judgment of Dismissal without Prejudice of Claims between Plaintiff Personal Audio, LLC and Defendant XM Satellite Radio Inc. judgment is entered below: 1. Plaintiff Personal Audio, LLC and Defendant XM Satellite Radio Inc. have resolved their respective claims and counterclaims pursuant to a stipulation among the parties dated July 13, 2010; 2. 3. The parties are bound by the terms set forth in their stipulation dated July 13, 2010; All pending claims in this action by Personal Audio, LLC against Defendant XM Satellite Radio Inc. are dismissed without prejudice; and 4. All pending claims in this action by XM Satellite Radio Inc. against Personal Audio, LLC are dismissed without prejudice.
