UNDER FEDERAL RULES OF CIVIL PROCEDURE 12(B)(1) AND 12(B)(6)
Upon consideration of Defendant and Counterclaimant Entrepreneur Media, Inc.’s
(“EMI”) Motion to Dismiss Under Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6), and
the related briefs and arguments of the parties, it is hereby
ORDERED AND ADJUDGED that EMI’s motion should be, and is hereby GRANTED.
Pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure, the claims in
Plaintiff’s Second Amended Complaint are hereby DISMISSED without leave to amend.
