This matter is before the Court on the motion by Defendant Peter Jarowey (“Jarowey”) to
quash service of process pursuant to Rule 12(b)(5) of the Federal Rules of Civil Procedure.
Having reviewed Jarowey’s motion, having considered the arguments by counsel, and otherwise
being fully advised, the Court:
HEREBY ORDERS, ADJUDGES AND DECREES AS FOLLOWS:
1. Defendant Jarowey’s motion is GRANTED and the service of process as to him
(Docket No 78) is quashed.
2. Plaintiff Incentive Capital, LLC must obtain an Amended Summons from the
Clerk of the Court and serve the Amended Summons and Amended Complaint
upon Jarowey within thirty (30) days of this Order.
