Josh,
With respect to Defendants’ proposed construction of “relevance to at least one of the query and the first user,”
the parties have already agreed to constructions for each of the components of this limitation.
Given the parties’ agreement on the construction of “user,” I/P Engine believes no further construction of
“individual user” and “first user” are necessary and believes the parties have already addressed these terms.

Dear Charles,
We continue to await Plaintiff’s response on whether it agrees with Defendants’ proposed construction of “relevance to
at least one of the query and the first user.”
In a further attempt to reach agreement or at least narrow the issues, we propose construing “individual user” and “first
user” as “particular user” rather than “a particular user.” This lines up more clearly with the terms at issue. In light of
this change, please let us know whether Plaintiff intends to retain its construction of those two terms as “a/the
individual user,” and in particular whether it will continue to include the “a/the” in its construction, which seems
confusing to us.
