The court authorizes the parties to begin the process of notifying class members of
their proposed settlement of this class action. The court gave preliminary approval to the
settlement in a June 11, 2012 order.

Attached to this order as Exhibit 1 is the form of notice (short-form notice) that the
court has approved to be mailed to each class member. Attached as Exhibit 2 is the
Claim or Exclusion Form that will accompany the short-form notice. 1 Defendant, in
coordination with the settlement administrator, must mail the substantial equivalent of the
short-form notice and Claim or Exclusion Form, along with a postage-prepaid return
envelope for the Claim or Exclusion Form, to class members by July 3, 2012, in
accordance with the June 11, 2012 order.

Finally, the court has extended the deadline for class counsel to file its motion for

attorney fees, costs, and an incentive award for Plaintiff from July 3, 2012 to July 10,

2012. From July 3 until the date the motion is available on the website, the settlement

6

website shall prominently display the notation “CLASS COUNSEL’S MOTION FOR

7

ATTORNEY FEES, COSTS, AND AN INCENTIVE AWARD FOR KEVIN

8

MCCLINTIC WILL BE AVAILABLE FOR REVIEW ON THIS WEBSITE NO LATER

9

THAN JULY 10, 2012.”
