This action came before the court for consideration with District Judge
William M. Conley presiding. The issues have been considered and a decision has
been rendered.

IT IS ORDERED AND ADJUDGED that judgment is entered in favor of
defendant and against the plaintiff Mark Mittelstadt. The decision of defendant
Tom Vilsack, then Secretary of the United States Department of Agriculture, is
affirmed. Judgment is further entered in defendant’s favor on plaintiff’s common law
breach of contract claim.
