This action came for consideration before the court on summary judgment with
District Judge William M. Conley presiding. The issues have been considered and a
decision has been rendered.

IT IS ORDERED AND ADJUDGED that judgment is entered in favor of
defendants Asset Recovery Specialists, Inc., Greg Strandlie and Wells Fargo Bank NA d/b/a
Wells Fargo Dealer Services and against plaintiff Danelle Duncan as to plaintiffs claim
under the Fair Debt Collection Practices Act ("FDCPA"), 15 U.S.C. § I692f (Count I of
the Complaint).
IT IS FURTHER ORDERED AND ADJUDGED that judgment is entered in favor
of defendant Wells Fargo Bank NA d/b/a Wells Fargo Dealer Services and against plaintiff
Danelle Duncan on state law claims premised on the same allegations concerning her
personal property underlying her FDCPA claim.
IT IS FURTHER ORDERED AND ADJUDGED that judgment is entered in favor
of defendant Wells Fargo Bank NA d/b/a Wells Fargo Dealer Services and against plaintiff
Danelle Duncan on plaintiffs unreasonable sale claim (Count VI of the Complaint).
IT IS FURTHER ORDERED AND ADJUDGED that plaintiff Danelle Duncan's
remaining state law claims are dismissed without prejudice.
