This action came before the court for consideration with District Judge
William M. Conley presiding. The issues have been considered and a decision has
been rendered.

IT IS ORDERED AND ADJUDGED that judgment is entered in favor of
defendants Francis D. Schmitz, John Chisholm, Bruce Landgraf, David Robles, Kevin
J. Kennedy, Shane W. Falk, Jonathan Becker, and Robert Stelter against plaintiff The
John K. MacIver Institute for Public Policy, Inc. granting defendants’ motions to
dismiss, denying plaintiff’s motion for preliminary injunction and for return of
property and closing this case.
