Re: The Authors Guild v. Google Inc., No. 13-4829-cv
In re September 11 Litigation, Nos. 13-3619-cv and 13-3782-cv
Dear Ms. Wolfe:
I am counsel of record for defendant-appellee Google Inc. in The Authors Guild v. Google Inc.,
No. 13-4829. I am also counsel of record for plaintiffs-appellants in In re September 11
Litigation, Nos. 13-3619 and 13-3782. I expect to present oral argument in each case.
I respectfully request that, if possible, oral arguments in these cases not be scheduled during the
same week. This Court recognized the complexity of the In re September 11 Litigation cases by
granting permission to file oversize briefs and declining to consolidate the two cases. Preparing
for and presenting oral argument in Authors Guild during the same week as the tandem oral
arguments in In re September 11 Litigation would be extremely difficult. I accordingly request
that oral argument in Authors Guild and In re September 11 Litigation be scheduled for different
weeks.
Sincerely,
/s/ Seth P. Waxman
Seth P. Waxman
