UNITED STATES COURT OF APPEALS
FOR THE NINTH CIRCUIT
VIDANGEL, INC.,
Defendant-Appellant,
No. 16-56843
v.
MOTION TO FILE UNDER SEAL
DISNEY ENTERPRISES, INC.;
LUCASFILM LTD. LLC;
TWENTIETH CENTURY FOX FILM
CORPORATION; AND WARNER
BROS. ENTERTAINMENT, INC.,
Plaintiffs-Appellees.
Pursuant to Interim Circuit Rule 27-13(e), Defendant-Appellant VidAngel,
Inc. (“VidAngel”) hereby moves to seal portions of the contemporaneously filed
Emergency Motion Under Circuit Rule 27-3 For A Stay Pending Appeal (the
“Emergency Motion”), as well as portions of the contemporaneously filed Appendix.
The text of the Emergency Motion and the lower court docket entries
contained in the Appendix contain references to confidential business information
that was produced in the district court by both VidAngel and Plaintiffs-Appellees,
but ordered sealed below.
VidAngel has filed an unredacted version of the Emergency Motion under
seal provisionally. VidAngel submits as an exhibit to this Motion a redacted version
of the Emergency Motion that it proposes be made publicly available. The redacted
1
version conceals approximately a handful of references to confidential business
information sealed below.
VidAngel’s Appendix contains both redacted and, in a separately marked
volume, unredacted versions of the relevant docket entries from the proceedings
below.
VidAngel accordingly requests that the unredacted Emergency Motion and
sealed portions of the Appendix be maintained as sealed documents and that the
redacted Emergency Motion attached as an exhibit, and those portions of the
Appendix not designated as filed under seal, be made publicly available.
