After review of the pleadings, records and files in this matter, and after opportunity for hearing and argument, the court finds that the complaint is not subject to Section 425.16 and that said motion was frivolous within the meaning of Section 425.16 (c) and Rule 11. Accordingly, IT IS ORDERED THAT: Defendants Mark Cuban and Dallas Basketball, Ltd.'s Special Motion to Strike Complaint Pursuant to California Code of Civil Procedure ' 425.16 is hereby DENIED.
