Hornbeck Offshore Services, L.L.C. v. Salazar et al Doc. 125 A IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF LOUISIANA HORNBECK OFFSHORE SERVICES, LLC, et al. Plaintiffs, v. KENNETH LEE "KEN" SALAZAR, in his official capacity as Secretary, United States Department of the Interior; UNITED STATES DEPARTMENT OF THE INTERIOR; MICHAEL R. BROMWICH, in his official capacity as Director, Bureau of Ocean Energy Management, Regulation, and Enforcement; and BUREAU OF OCEAN ENERGY MANAGEMENT, REGULATION, AND ENFORCEMENT, Defendants. CIVIL ACTION No. 10-1663(F)(2) SECTION F JUDGE FELDMAN MAGISTRATE 2 MAGISTRATE WILKINSON [PROPOSED] ORDER Before the Court is Defendants' Motion to Dismiss or, in the Alternative, for a Stay of Proceedings Pending Circuit Court's Decision on Defendants' Motion to Vacate the Preliminary Injunction. The Court has considered the motion, the briefs in support and opposition thereto, and the Secretary of the Interior's July 12, 2010 Directive, which supersedes the May 28, 2010 Directive and rescinds the Notice to Lessees, both of which are the subjects of the present suit. Based upon the July 12, 2010 Directive, Plaintiffs' claims in the present suit are now moot and this Court therefore lacks jurisdiction. Defendants' Motion to Dismiss is therefore GRANTED. SO ORDERED. Dated: __________________ ___________________________________ MARTIN L.C. FELDMAN UNITED STATES DISTRICT JUDGE Dockets.Justia
