We agree to make accessible for forensic examination and imaging, the electronic
media and files that Mr. Gordon has located after a reasonable and diligent search.
We will provide such materials to a third party forensic examiner provided defendants
acknowledge and agree that (i) such media will be returned to Fish & Richardson
immediately after the forensic examination and imaging is conducted; and (ii) any
notes, reports, analysis or other communication from the forensic examiner regarding
the results of the forensic examination are provided to Fish & Richardson within a
day after defendants’ receipt of same.
