BITTERROOT PUBLIC LIBRARY, CITY OF HAMILTON, LEE ENTERPRISES, INC., and BOONE KARLBERG P.C., Defendants. COMES NOW Co-Defendant, Lee Enterprises, Inc. (“Lee Enterprises”), through its counsel, Garlington, Lohn & Robinson, PLLP, and hereby moves the Court to vacate all pending deadlines in this matter. On December 12, 2011, a bankruptcy case concerning Lee Enterprises was filed under Chapter 11 of the U. S. Bankruptcy Code. As a result, an automatic stay of this proceeding has been 1 1092932 imposed pursuant to 11 U.S.C. § 362. For said reason, Lee Enterprises requests this motion be granted and the Order (Dkt. 182), as it pertains to Lee Enterprises, be vacated, and all matters be stayed pending resolution of the above-referenced bankruptcy court proceedings, including, but not limited to, time limits for: Lee Enterprises’ response to Plaintiff’s discovery requests; Lee Enterprises’ objections to the Magistrate’s Findings of Fact and Recommendations (Dkt. 181); and Lee Enterprises’ response to Plaintiff’s Objection to Part, to Agree in Part; to the Court’s Findings of Fact in re: Lee Enterprises, Inc. (Dkt. 188). Pursuant to L.R. 7.1(c)(1), Lee Enterprises’ counsel has contacted Plaintiff and all counsel. Counsel for co-defendants does not oppose this motion. Plaintiff does oppose this motion.
