POKERSTARS, et al. : : 11 Civ. 2564 (LBS) : ORDER Defendants; ALL RIGHT, TITLE AND INTEREST IN THE ASSETS OF POKERSTARS, et al., : : : Defendants in rem. : : - - - - - - - - - - - - - - - - - -x Upon consideration of the motion by the United States of America to (1) Conduct Expedited Discovery Relating to Fugitive Disentitlement, and (2) Stay Consideration of the Pokerstars Claimants’ Motion to Dismiss the Verified First Amended Complaint; IT IS HEREBY ORDERED that the motion is granted, and IT IS FURTHER ORDERED that consideration of the motion to dismiss submitted by the PokerStars Claimants be stayed pending expedited discovery and the Court’s consideration of the applicability of the fugitive disentitlement statute to the PokerStars Claimants, and that all current response and reply deadlines related to that motion to dismiss are hereby terminated, and; IT IS FURTHER ORDERED THAT the Government shall be permitted to serve document requests and interrogatories, take depositions, and serve requests for admission relating specifically to the applicability of the fugitive disentitlement statute to the PokerStars Claimants. Such discovery period shall close ninety days from the date of this Order, unless there is further order from the Court, and; IT IS FINALLY ORDERED THAT the Government shall have 30 days from the close of this discovery period to file a motion for summary judgment exclusively on the issue of applicability of fugitive disentitlement to the PokerStars claimants.
