I have received your email and acknowledge that you are cancelling the deposition of Mr. Lesnevich on
Wednesday. Unfortunately, Mr. Lesnevich is already on his way to New York for the deposition. Moreover, Mr.
Lesnevich was planning to provide some supplemental findings at the deposition. Given your cancellation, we anticipate
providing these supplemental findings in written form. Defendants reserve all rights, including the right to seek costs for
Mr. Lesnevich’s travel and appearance, as well as costs for counsel’s preparation of the deponent.
