IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF TEXAS TYLER DIVISION WI-LAN INC., Plaintiff, v. CIVIL ACTION NO. 6:10–CV–521–LED ALCATEL–LUCENT USA INC., et al., Defendants. WI-LAN AND ERICSSON’S JOINT MOTION TO EXTEND MEDIATION DEADLINE On September 30, 2013, the Court ordered the parties to engage in post-trial mediation by November 1, 2013. In connection with an appeal of a related lawsuit now pending at the Federal Circuit, Plaintiff Wi-LAN Inc. and Defendants Telefonaktiebolaget LM Ericsson and Ericsson Inc. (collectively, “Ericsson”) had previously scheduled a court-ordered mediation on November 19-20, 2013. The parties plan for such mediation to be directed to a possible resolution of the entire dispute between Wi-LAN and Ericsson, including this litigation, as all prior mediations have been. To avoid unnecessary duplication of efforts and expenses, the parties respectfully request that the Court extend the November 1st mediation deadline until November 22nd to accommodate the parties’ previously scheduled mediation.
