TEMORARY RESTRAINING ORDER Having reviewed Plaintiff’s Motion for Temporary Restraining Order and Preliminary Injunction to Preserve the Status Quo, memorandum and proof in support, and Defendants’ opposition thereto, IT IS HEREBY ORDERED, that: 1. The Court GRANTS Plaintiff’s Motion for Temporary Restraining Order as set out below as Plaintiff has demonstrated that absent this relief, he will suffer irreparable injury that includes damage to his reputation and being subject to a constitutionally infirm arbitration hearing to which he did not agree. THE COURT FURTHER ORDERS THAT: 2. Any action by the USADA Defendants to enforce the asserted requirement that Mr. Armstrong elect, by July 14, 2012 or by any other date, arbitration of the June 12, 2012 and June 28, 2012 charges or accept the sanctions specified therein is stayed and enjoined pending a hearing on and resolution of Mr. Armstrong’s Motion for Preliminary Injunction. 3. Any action by the USADA Defendants to impose any sanction, cost, or fine on Mr. Armstrong or to disqualify any competitive results achieved or held by Mr. Armstrong, based on the allegations in the June 12, 2012 and June 28, 2012 letters, is stayed and enjoined pending a hearing on and resolution of Mr. Armstrong’s Motion for Preliminary Injunction. 4. Any other action by USADA Defendants in furtherance of the pursuit of doping charges, the imposition of sanctions, or with respect to disqualification of competitive results held by Mr. Armstrong based on the allegations in the June 12, 2012 and June 28, 2012 letters is stayed and enjoined pending a hearing on and resolution of Mr. Armstrong’s Motion for Preliminary Injunction. 5. There is no requirement of any bond. A hearing on Mr. Armstrong’s Motion for a Preliminary Injunction is scheduled for _________________.
