On April 13, 2016, the court held a telephonic hearing on the State defendants' motion to
compel discovery, dkt. 95 . All parties (including the Taylor County defendants) were
represented by counsel. In discussion with the parties, the court granted the motion in part and
denied the rest without prejudice to renewal. More specifically, in response to Interrogatories 1
through 5, plaintiff must report for each of her five claims which paragraphs of her amended
complaint apply to which of her five claims. Plaintiff must provide the same five-part breakout
by paragraph of the information on which she is claiming reliance from dkt. Nos. 16 -2 and 16
-3. These disclosures do not freeze the factual record: plaintiff may supplement them as this
case progresses. Plaintiff does not have to amplify her responses to Interrogatories 7 and 8 at
this time. That said, the State is entitled to a tighter presentation of plaintiff's support for her
claim that every new statute and every amended statute that is part of Act 292 is facially
unconstitutional under the First, Fourth, Fifth, Ninth and Fourteenth Amendments. Plaintiff
soon will have to gloss with more precision her facial challenge to Act 292, so she had better
start thinking about how she intends to do this. Finally, in response to concerns raised by the
Taylor County defendants, the court is willing to grant a request to extend dates and deadlines
in this case, including the dispositive motion deadline and the trial date, once the need to do so

On April 12, 2017, the court held a telephonic hearing on defendant Taylor County's Motion for
a Protective Order 230 . After discussing the motion with all who wished to be heard, the court
denied it for reasons stated. That said, the jail has raised legitimate logistical concerns that must
be addressed by the parties. Counsel are to meet and confer forthwith to attempt to reach an
agreement on the details of the video recording. If agreement eludes them, then counsel must
promptly notify the court so that it can convene a follow-up telephonic conference to resolve
the disputes.
The court also advised the parties that their April 14, 2017 submission deadline is stricken, the
May 22, 2017 trial date remains firm, and Judge Peterson will hold his telephonic status
conference with counsel promptly after he enters his order(s) on the pending summary judgment
