Plaintiff IconFind, Inc. (“IconFind”) respectfully applies for leave to file IconFind’s
Supplemental Response to the Court’s December 7, 2009 Question Regarding “Network Page”,
which is attached hereto as Exhibit A. Following the December 7, 2009 hearing, the Court
issued a minute order taking Defendant’s Motion For Claim Construction under submission.
(See Dkt. #48). Pursuant to Local Rule 230(g), Plaintiff now seeks to reopen the matter for the
limited purpose of submitting its two-page supplemental response to the Court’s question.
Local Rule 230(g) provides:
(g) Hearing and Oral Argument. Upon the call of the motion, the Court will hear
appropriate and reasonable oral argument. Alternatively, the motion may be
submitted upon the record and briefs on file if the parties stipulate thereto, or if
the Court so orders, subject to the power of the Court to reopen the matter for
further briefs or oral arguments or both. Any party that believes that extended
oral argument, more than 10 minutes per side or 20 minutes in the aggregate, will
be required shall notify the courtroom deputy clerk so that the hearing may be
rescheduled if deemed appropriate by the Court.
L.R. 230(g) (effective Dec. 1, 2009) (emphasis added). Accordingly, this Court has the power
to reopen the matter for the limited purpose of IconFind’s supplemental response.
Specifically, at the December 7, 2009 claim construction hearing, the parties discussed
the potential application of the term “network page” to items such as image files. During this

discussion, the Court inquired whether the plain and ordinary meaning of a “page” on a network
17
can apply to an image on a page. IconFind does not seek to amend its counsel’s response to the
18
Court’s question, or to change its position in any way, but merely seeks to clarify the record so
19
that there is no misinterpretation at a later point in this proceeding.

For all of the foregoing reasons, Plaintiff IconFind, Inc. respectfully applies for leave to
21
file IconFind’s Supplemental Response to the Court’s December 7, 2009 Question Regarding
22
“Network Page.”
