Please see the attached infringement charts for Google Browser and YouTube Player for
Android 3.0 Operating System. As far as we have been able to determine, Google released
Android 3.0 on February 22, 2011, and certainly did so after the date of Eolas’ initial
infringement contentions. Accordingly we have produced the attached infringement charts for
Google Browser and YouTube Player for Android 3.0 Operating System and provided them to
you as quickly as possible.
We intend to move the Court for leave to supplement our infringement contentions to
include the Google Browser and YouTube Player for Android 3.0 Operating System charts
attached hereto. Please let us know at your earliest convenience if you oppose, and, if so, on
what basis.
